Local – A Commerce woman is out of jail on bond after being arrested for the 2nd-degree vehicular homicide of a White County man.
Information from officials states, that 26-year-old, Kayla Brooke Osburn has been charged in last year’s death of 62-year-old Cleveland resident, Wendell Lovell.
Wendell, an Army veteran, was killed on April 20th last year when, according to state troopers, a Hyundai Elantra driven by Osburn crossed over the center line on Highway 115 near Holiness Campground Road, striking his pickup truck. The impact caused the Chevy S-10 to overturn, killing Lovell and injuring Osburn.
In addition to vehicular homicide, authorities charged her with failure to maintain lane. Both charges are misdemeanors.
Osburn was taken into custody on Jan. 23rd and booked at the White County Detention Center. She was later released on a $3,000 bond.
Misdemeanors? Really?. She should stay in jail !! She killed a man!!!
I agree with Donna, how in the world is Vehicle Homicide a misdemeanor?!?!
Misdemeanor or 2nd degree homicide by vehicle occurs when a death results from an accident caused by any misdemeanor traffic violation other than those specified for a felony charge. Common violations that lead to vehicular homicide charges include: Failing to stop at a red light or stop sign, Failure to yield right of way or maintain lane, Speeding, Driving too fast for conditions and Texting while driving.
Lee, I appreciate the explanation..
